Denver Drug CourtEligibility for drug court is based on a number of factors, including:

  • First-time offenders.
  • Possession of less than 25 grams.
  • No previous convictions involving serious bodily injury or death.
  • No previous convictions involving a deadly weapon.
  • No previous conviction of a sex offense.
  • Must reside in the Denver Metro area.
  • Must demonstrate substance abuse problems.
  • Must not be on parole.

For some first-time drug offenders, Denver Drug Court may be an option. The program emphasizes treatment over jail and attempts to assist defendants in overcoming their substance abuse issues. In some cases, successful completion may result in a reduction or dismissal of the charges. However, the program has extensive testing and reporting requirements and is not for everyone. Violations can result in additional community service hours, extending the length of participation in the program, or jail time.

Phase 1

  • Participation in a treatment program.

  • Establishment and compliance with a repayment plan.

Phase 2

  • Must have 90 consecutive days of clean urine tests.
  • 60 days without a missed urine test.
  • Active payment plan established.
  • Compliance with all treatment guidelines.
  • Compliance with terms and conditions of probation.
  • Begins work on community service obligations.

Phase 3

  • Submit to 2-3 urine tests a month.
  • Ongoing treatment as required.
  • Attends drug court review hearings as scheduled.
  • Remains current on payment of all costs and fees.
  • Completes all community service requirements.
